Terms of Use

1. Acceptance of these Terms.

These Terms of Use ("Terms") form a binding agreement between you and Moneydy, an independent service established in Portugal, European Union ("Moneydy", "we", "us"). By creating an account or otherwise using the Moneydy website and application (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility.

You must be at least 16 years old to use the Service. By registering, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. The Service is intended for personal, non-commercial use.

3. Your account.

You are responsible for the accuracy of the information you provide at registration and for keeping your credentials confidential. You are responsible for all activity that occurs under your account. Notify us at moneydy.official@gmail.com if you suspect any unauthorized access.

4. Use of the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in a way that violates any applicable law or regulation;
• Attempt to gain unauthorized access to any part of the Service or to other users' accounts;
• Interfere with, disrupt, or place unreasonable load on the Service, including by automated means (scraping, bots, stress testing) without our written permission;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent that such activity is expressly permitted by applicable law;
• Upload content that is unlawful, infringing, defamatory, or that contains malware.

5. Your content.

Moneydy lets you record self-reported financial data (transactions, budgets, savings, investments) and related notes. You retain all rights in the content you enter. You grant us a limited, non-exclusive licence to host, store, process, and display that content solely as needed to operate the Service for you. We do not use your financial records for advertising and we do not sell them.

6. Free and Premium plans.

Moneydy offers a free plan and, where available, a Premium subscription. Premium features, prices, and billing cycles are shown on the pricing page before you subscribe. Payments are processed by Stripe; billing starts when your subscription becomes active and renews automatically until cancelled. You can cancel your Premium subscription at any time; cancellation takes effect at the end of the current billing period and no pro-rata refund is given for the unused portion, except where required by law. Statutory consumer rights, including the 14-day right of withdrawal under EU law, are not affected.

7. Intellectual property.

The Service, including its design, branding, logos, text, graphics, and underlying software, is owned by Moneydy or its licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any right, licence, or interest in Moneydy's intellectual property other than the limited right to use the Service as provided.

8. Availability and changes to the Service.

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where the change materially affects paying users.

9. Disclaimer.

The Service provides tools to help you organize your personal finances. It does not provide financial, investment, tax, legal, or other professional advice, and nothing in the Service should be treated as such. You are solely responsible for decisions you make based on the information you enter or on the summaries the Service displays. The Service is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded under mandatory law.

10. Limitation of liability.

To the maximum extent permitted by law, Moneydy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or in connection with your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence.

11. Termination.

You may close your account at any time from your account settings or by contacting moneydy.official@gmail.com. We may suspend or terminate your access if you materially breach these Terms or if required by law. Upon termination, your data will be handled as described in the Privacy Policy.

12. Governing law and jurisdiction.

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. The courts of Porto, Portugal have non-exclusive jurisdiction over any dispute arising under these Terms, without prejudice to mandatory consumer protections that may grant you the right to bring proceedings in the courts of your country of residence.

13. Changes to these Terms.

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent change. For material changes we will notify you by email or in-app banner before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
